Terms of Service
These terms are an agreement between Skhatsi Itstime (Pty) Ltd (registration number 2024/563305/07) ("we", "us") and the company that creates a Bid Environment register, and each person who uses it ("you"). By creating an account or accepting an invitation, you agree to them and to our Privacy Policy.
1. The service
Bid Environment is a bid workflow tool for tender teams. You register tenders, track dates, tasks and returnables, and get reminders. It does not find tenders for you. It also does not check whether your submission complies with a tender's requirements. You remain responsible for reading each tender document, meeting its requirements and submitting on time. The app helps you keep track, but a missed deadline or a missing document is not our responsibility.
2. Accounts and security
- Give accurate details, and keep your password and two-step login to yourself. You are responsible for what happens under your login.
- Admins must use two-step login. Admins decide who joins their company's register and what role each person has.
- Tell us straight away at [email protected] if you think someone else has used your account.
3. Your data
Your company owns the information and documents it puts into its register. We use them only to provide the service, as set out in the Privacy Policy. An Admin can download all of the company's data at any time, and can delete the company. It is then erased 30 days later.
Only upload what you are entitled to share. If your register contains other people's personal information, such as directors' or contacts' details, your company is responsible for having a lawful reason to hold it.
4. Acceptable use
Do not use Bid Environment to break the law, to upload malware, to try to access another company's data, to probe or overload the service, or to send spam through its email features. We may suspend access that puts the service or other users at risk. Where we can, we will tell you first.
The platform belongs to us. Bid Environment itself (its software, design, text, checklists, templates, name and logo) belongs to Skhatsi Itstime (Pty) Ltd and is protected by copyright and other law. Your subscription lets your company use it; it does not transfer any ownership. You may not:
- copy, reproduce, resell or sublicense the platform or any part of it;
- scrape or bulk-download content with bots or other automated tools, except by exporting your own company's data with the export features we provide;
- decompile, reverse-engineer or try to extract the platform's source code;
- use your access to build, or help someone else build, a competing product;
- remove our copyright notices, or use the Bid Environment name or logo without our written permission.
We may suspend or end access that breaks these rules, and take legal action where needed. None of this affects your company's ownership of its own data (section 3).
5. Plans and payment
- The current plans, limits and prices are shown on our website and in the app's Billing tab. Each company register is billed separately.
- Paid plans are billed monthly in advance through PayFast.
- You can cancel at any time from the Billing tab. You keep the paid plan until the end of the period already paid for, and it then moves to the Free plan. We do not refund part-months, except where the law requires it.
- If a payment fails, the company may be moved to the Free plan. Your data is kept, but Free plan limits apply.
- We will give at least 30 days' notice before changing the price of a plan you are paying for.
6. Availability and changes
We work to keep Bid Environment available and your data safe, and we monitor it and keep backups. We cannot promise it will never be interrupted. If an interruption affects an upcoming deadline, don't rely on the app alone: keep your own copy of critical dates. We may improve or change features over time. If we remove something important you rely on, we will tell you in advance.
7. Liability
To the extent the law allows, we are not liable for indirect or consequential loss, including lost tenders, contracts or profit. Our total liability for any claim is limited to the fees your company paid us in the three months before the claim. Nothing in these terms limits rights you have under the Consumer Protection Act or other law that cannot be excluded.
8. Ending the agreement
You can stop using Bid Environment at any time, and an Admin can delete the company from the Billing tab. We may end or suspend an account that seriously breaches these terms. We will give notice where we reasonably can, and a chance to download the company's data.
9. Changes to these terms, and the law that applies
If we change these terms, we will publish the new version here with a new version date. If the change is material, we will tell your company's Admins by email before it takes effect. If you keep using the service after a change takes effect, you accept the new version. These terms are governed by the law of the Republic of South Africa.
